Terms and Conditions

AGREEMENT FOR CALVIEW NETLINK INTERNET SERVICES

CALVIEW NETLINK™ is an Internet Web Presence Service Provider and Networking Services, subject to your compliance with the terms and conditions set forth below.  CALVIEW NETLINK™ may modify these terms and conditions at any time, and such modifications shall be immediately effective upon posting of the modified agreement.  You agree to review the agreement periodically to be aware of such modifications and your subscription to the service shall be deemed your conclusive understanding and acceptance of the modified agreement.

Conditions
Person(s) applying for the service must be 18 years of age or older.  Minors can be authorized to use this service with the consent of an adult; however, the account must be in the adults name.  It is the adult's responsibility to ensure that the bill is paid in a timely manner.  The customer is responsible to keep all registration information current, including your address and billing information.

Payments of Fees

  • Check or money order clients will be sent an invoice via post office or electronic mail to the user's account at the beginning of the month.  A returned check charge of $10.00 will be incurred for all returned checks and credit card transactions.
  • Visa, Master Card, American Express credit cards are also welcome.   Invoice will be sent electronic mail to the user if paying by credit card.
  • Credit card payment will be required immediately after sign-up is completed.
  • Charges incurred due to additional usage or services will be billed with the next month's fee.
  • CALVIEW NETLINK™ reserves the right to suspend accounts if payment has not been received.

Some websites charge access fees and/or sell products and/or services.  CALVIEW NETLINK™ does not impose these fees, but the party hosting the website is responsible.  Charges incurred by visiting such a web site and/or purchases that are made are the sole responsibility of the subscriber.

CALVIEW NETLINK™ is not responsible for additional fees charged by the phone company(ies) due to long distance calls and/or additional services, such as ISDN connections.   Questions/Concerns with a subscriber's phone bill should be handled directly with the subscriber's phone company.  This includes calls to Calview Netlink™ Sales, Tech Support, and Billing.

Fees are subject to change without notice.  Currently, this service is not subject to state tax; however, if this changes the customer will be responsible for the government imposed fees.

Guarantee Money-Back

  • If a customer is not satisfied with the services which CALVIEW NETLINK™ provides, the monthly payment will be refunded if the customer has been connected to CALVIEW NETLINK for less than 4 hours.
  • If a customer is never able to connect to the service and has worked with technical suppport to get it working, the set-up fee and monthly payment are refundable.
  • CALVIEW NETLINK™ must be notified within the first 30 days of subscription to be eligible for any type of refund.  Beyond the 30 days, refunds will not apply.
  • If service is cancelled after 30 days, the customer is responsible for payments incurred up to the date of cancellation.

    Use of Services

    Under this agreement, CALVIEW NETLINK™ will provide the following:

    CALVIEW NETLINK™ will provide dial-up access to the Internet, email account, web page (depending on service package), and software for IBM compatible systems.  The customer will provide the computer, the modem, and the phone connection.

    Dial-Up access is defined as an on-demand, temporary connection to the Internet.   Using artificial means to maintain a continuous connection is not permitted.   CALVIEW NETLINK™ has the right to terminate any connection lasting more than 12 consecutive hours.  Repeated violations will lead to a suspension of the service.

    Web page design is defined as an on-demand HTML creation for the customer's web presence needs.  CALVIEW NETLINK™ will require an equal amount of deposit for web page creation of the time spent and other charges (i.e. internic and setup fees for the domain name) that may apply in creating the pages.  CALVIEW NETLINK™ will provide all graphics and text to the customer and deposits are not refundable if such cancellation is made and the customer shall forfeit all remaining deposits and services with CALVIEW NETLINK™.

    CALVIEW NETLINK™ does not allow concurrent use of accounts.  Each concurrent connection to CALVIEW NETLINK™ with the same account will be warned the first time, for the second time around the account will be terminated with no refund.  Concurrent connections with the same account may be treated as another and can be billed accordingly.  This will be billed EVERY time an account is logged on concurrently.  CALVIEW NETLINK™ strongly recommends that the customer not share his or her password with anyone.

    CALVIEW NETLINK™ will make every effort to notify all of our customers via-email for any scheduled downtime.  There may be a few rare exceptions when CALVIEW NETLINK™ will not be able to notify you of downtime due to circumstances beyond CALVIEW NETLINK™'s control.

    CALVIEW NETLINK™ does not restrict personal e-mail.  However spamming and bulk e-mail are strictly prohibited.  ('Spamming' refers to the act of sending unsolicited bulk e-mail.  Bulk e-mail is defined as a high volume of messages).  If a person is suspected of spamming or sending bulk e-mail, their account will be immediately deactivated.  CALVIEW NETLINK™ will reactivate the account after a discussion with the offending party.  If it is confirmed that the party has violated the CALVIEW NETLINK™ spamming policy we reserve the right to charge up to $1000.00 fine and permanently terminate the account with no refund.

    CALVIEW NETLINK™ is not responsible for any material that is posted to a web page that infringes upon copyrights, trademarks, and other liabilities.  CALVIEW NETLINK™ will work with the law enforcement officials and will release information that is necessary for any investigations.  If CALVIEW NETLINK™ notices abuse, CALVIEW NETLINK™ will promptly notify the subscriber(s).  Upon notification, immediate corrective action shall be taken by the subscriber(s) or CALVIEW NETLINK™ will suspend the account(s).  The party(s) involved are responsible for charges that accrue while the account is suspended.

    • Some web sites host adult and/or inappropriate material on the Internet.  CALVIEW NETLINK™ is not responsible for the material on any of these sites.  CALVIEW NETLINK™ reserves the right to suspend home page(s) and/or accounts that distribute material(s) in violation with the law.
    • As provided by United States federal law and by International treaties, copyrighted materials (example: programs, images, and text) may not be uploaded using CALVIEW NETLINK™ services without the permission of the copyright holder.  Copyrighted materials may be downloaded for personal use.
    • Note that some materials are available on the Internet and are called "SHAREWARE."   The copyright holder usually gives permission to use the materials for examination.   If you choose to continue using the materials, the copyright holder requests that you register your usage and may ask that you pay a license fee.

    The subscriber acknowledges that information available through the interconnecting networks may not be accurate.  CALVIEW NETLINK™ can make no warranty of any kind, either expressed or implied, regarding the quality, accuracy, or validity of the data and/or information residing on or passing through these networks.  Use of information obtained from or through CALVIEW NETLINK™ services is at the risk of the subscriber.

    The subscriber agrees to indemnify and hold CALVIEW NETLINK™ harmless from all claims, losses, expenses and attorney's fees for injuries to or death of any person and for damages to or loss of any property which may in any way arise out of, or result from, or in connection with, your use of the CALVIEW NETLINK™ services.

    CALVIEW NETLINK™'s technical support extends to configuring and maintaining Internet access, e-mail accounts, and web pages.  Other issues resulting from website specific applications may not be supported.  CALVIEW NETLINK™ will provide other services such as installing and upgrading computer hardware and software for a seperate fee.

    CALVIEW NETLINK™ is not responsible for damage to a computer resulting from the assistance of technical support.

    CALVIEW NETLINK™ is not responsible for damage to a computer caused by downloading softwares which contain viruses.  In addition, CALVIEW NETLINK™ is not responsible for any software or system failures encountered during the installation or use of the software provided by CALVIEW NETLINK™.

    Account Cancellation

    Cancellation requests may be processed via-email to technical support, contacting CALVIEW NETLINK™ at 408-727-4601, or postal service at CALVIEW NETLINK™'s main office.

    • In the event that a subscriber cancels service, the user's account(s), e-mail(s), and web page will be set to be canceled on the requested day of the month.  A $20.00 fee to re-activate the account will apply.  Reactivation before the end of the month will not incur a fee.
